1. ACCEPTANCE OF TERMS

By accessing, browsing, or using the AndesMotoRent website, mobile application, or services (collectively, the “Service”), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (“Terms”) and our Privacy Policy. If you do not agree to these Terms, you must not use our Service.

 

These Terms constitute a legally binding agreement between you (“User,” “Customer,” or “you”) and AndesMotoRent (“Company,” “we,” “us,” or “our”).

 

2. DESCRIPTION OF SERVICE

AndesMotoRent operates a motorcycle rental platform that connects motorcycle owners with individuals seeking to rent motorcycles. We facilitate bookings, payments, and provide customer support services. We do not own the motorcycles listed on our platform unless explicitly stated

 

2.1 SERVICE COMPONENTS

    • Online marketplace for motorcycle rentals

    • Booking and reservation system

    • Payment processing services

    • Customer support
    • Insurance coordination (where applicable)Identity verification services 
    • You must be at least 21 years old to use our Service. By using the Service, you represent and warrant that you meet this age requirement.

To rent a motorcycle, you must possess:

    • A valid motorcycle license or endorsement

    • A valid driver’s license

    • Meeting any additional licensing requirements in your jurisdiction

3.3 ACCOUNT REGISTRATION

    • You must provide accurate, current, and complete information during registration

    • You are responsible for maintaining the confidentiality of your account credentials

    • You must notify us immediately of any unauthorized use of your account

    • You may not create multiple accounts or share your account with others

3.4 ACCOUNT VERIFICATION

We reserve the right to verify your identity, driving record, and other information before approving your account or rental requests.

 

4. RENTAL TERMS AND CONDITIONS

4.1 Booking Process

    • All rentals must be booked through our platform

    • Bookings are subject to availability and owner approval

    • We reserve the right to cancel bookings that violate these Terms

4.2 Rental Requirements

Renters must:

    • Meet all eligibility requirements

    • Provide valid identification and licensing

    • Complete any required safety briefings

    • Inspect the motorcycle before and after rental

    • Return the motorcycle in the same condition as received

4.3 Prohibited Uses

The rented motorcycle may not be used for:

    • Racing, competitions, or time trials

    • Off-road riding (unless specifically permitted)

    • Commercial purposes without prior approval

    • Illegal activities

    • Transportation of illegal substances

    • Subleasing or re-renting to third parties

4.4 Geographic Restrictions

Motorcycles may only be operated within agreed geographic boundaries. Cross-border travel requires prior written consent.

5. PAYMENT TERMS

5.1 Pricing

    • Rental rates are set by motorcycle owners and displayed on our platform

    • All prices are in USD unless otherwise specified

    • Additional fees may apply for extras, insurance, or services

5.2 Payment Processing

    • Payment must be made through our approved payment methods

    • We use third-party payment processors and are not responsible for their policies

    • Payment authorization may be required before rental pickup

5.3 Security Deposits

    • A security deposit may be required for all rentals

    • Deposits will be held and released subject to vehicle condition and terms compliance

    • Deposits may be applied to damages, fines, or other charges

5.4 Cancellation and Refunds

    • Cancellation policies are set by individual owners

    • Processing fees may apply to cancellations and refunds

    • Refunds are processed through the original payment method

    • Weather-related cancellations are subject to individual owner policies

6. INSURANCE AND LIABILITY

6.1 Insurance Requirements

    • Renters must maintain valid motorcycle insurance or purchase coverage through our platform

    • Minimum coverage requirements apply and vary by location

    • Proof of insurance must be provided before rental

6.2 Liability Limitation

    • Renters are fully liable for damages to the motorcycle during the rental period

    • AndesMotoRent’s liability is limited to the maximum extent permitted by law

    • We are not liable for personal injuries, property damage, or consequential damages

6.3 Indemnification

You agree to indemnify and hold harmless AndesMotoRent, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

7. MOTORCYCLE OWNERS (HOSTS)

7.1 Listing Requirements

Owners must:

    • Provide accurate motorcycle descriptions and photos

    • Ensure motorcycles meet safety and legal requirements

    • Maintain proper registration and insurance

    • Disclose any known defects or issues

7.2 Owner Responsibilities

    • Maintain motorcycles in safe, roadworthy condition

    • Comply with all applicable laws and regulations

    • Respond promptly to booking requests and communications

    • Provide keys, documentation, and any required briefings

7.3 Commission and Fees

 

    • AndesMotoRent charges a service fee on all completed rentals

    • Payment to owners is processed according to our payment schedule

    • Additional fees may apply for services, insurance, or platform features

8. INTELLECTUAL PROPERTY

8.1 Platform Content

All content on our platform, including text, graphics, logos, software, and design elements, is owned by AndesMotoRent or our licensors and is protected by intellectual property laws.

8.2 User Content

 

    • You retain ownership of content you upload but grant us a license to use it

    • You warrant that your content does not infringe on third-party rights

    • We may remove content that violates these Terms or applicable laws

8.3 Prohibited Use

You may not copy, reproduce, distribute, or create derivative works from our platform content without written permission.

9. PRIVACY AND DATA PROTECTION

Your privacy is important to us. Please review our Privacy Policy, which governs the collection, use, and disclosure of your personal information. By using our Service, you consent to our privacy practices.

10. PROHIBITED CONDUCT

Users may not:

 

    • Violate any applicable laws or regulations

    • Impersonate others or provide false information

    • Interfere with the operation of our platform

    • Engage in fraudulent or deceptive practices

    • Harass, threaten, or abuse other users

    • Upload malicious code or attempt to breach security

11. DISPUTE RESOLUTION

12. TERMINATION

12.1 Termination by User

You may terminate your account at any time by contacting customer support or using account deletion features.

12.2 Termination by AndesMotoRent

We may terminate or suspend your account immediately for:

 

    • Violation of these Terms

    • Fraudulent or illegal activity

    • Safety concerns

    • Non-payment of fees

    • Abuse of other users or our staff

12.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Provisions that should survive termination will remain in effect.

13. DISCLAIMERS AND WARRANTIES

13.1 Service Disclaimer

Our Service is provided “as is” and “as available” without warranties of any kind, either express or implied.

13.2 Motorcycle Condition

We do not warrant the condition, safety, or roadworthiness of motorcycles listed on our platform. Users rent at their own risk.

13.3 Third-Party Services

We are not responsible for third-party services, websites, or content linked from our platform.

14. LIMITATION OF LIABILITY

To the maximum extent permitted by law, AndesMotoRent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims arising from or related to the Service shall not exceed the amount paid by you to AndesMotoRent in the twelve (12) months preceding the claim.

15. FORCE MAJEURE

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or government actions.

16. GOVERNING LAW AND JURISDICTION

21.5 Traffic Violations

Renters are responsible for all traffic violations, parking tickets, and fines incurred during the rental period.
